1. Introduction

These Terms and Conditions (hereinafter — "Terms") govern the use of the website xparagliding.com (hereinafter "Platform") and the services available thereon.

By accessing our Platform, creating an account, or booking any service, you confirm that you have read, understood, and fully agree to these Terms. If you do not agree with these Terms, please do not use the Platform.

2. Platform Role and Status

xparagliding.com is a digital booking platform and intermediary (aggregator) between paragliding service providers (companies and pilots) and users (passengers/tourists).
The Platform itself does not conduct flights and does not own paragliding equipment.
The direct service provider is the company or certified pilot with whom the user makes a booking through the Platform.

3. Passenger (User) Rights and Obligations

Age and health restrictions: The user assumes responsibility to confirm that they do not have health conditions (e.g., heart disease, epilepsy, etc.) incompatible with extreme flying. Minors may fly only with written parental/guardian consent and in compliance with the provider company's internal regulations.
Accuracy of information: During registration and booking, the user is obligated to provide accurate personal and contact information.
Code of conduct: The user is obligated to follow all instructions from the pilot and instructor during takeoff, flight, and landing.

4. Service Provider (Companies/Pilots) Obligations

All companies and pilots registered on the Platform operate independently.
The provider is obligated to hold all necessary licenses, permits, and certificates required by Georgian legislation and the Georgian Civil Aviation Agency (GCAA).
The provider assumes full responsibility for flight safety, technical integrity of equipment, and passenger briefing.

5. Bookings, Payments, and Pricing

Payment methods: Payments on the Platform are processed through secure electronic systems, specifically through the Bank of Georgia (BOG) payment portal. Full or partial (deposit) prepayment of the service fee may be required to confirm a booking.
Pricing: All prices are listed in the respective currency and include taxes as required by law. Prices are set by the service provider companies themselves.
Digital certificates and media: If the service includes photo/video recording or a flight certificate, online delivery of these materials may be provided by the Platform or directly by the provider.

6. Booking Cancellation and Refund Policy

Weather conditions: Paragliding is directly dependent on meteorological conditions. In documented cases of flight cancellation due to bad weather, the booking will be rescheduled or the user will receive a full refund, in accordance with the provider's policy.
Cancellation by user: Cancellation by the user within the established timeframe (typically at least 24 hours before the flight) may qualify for a refund. In cases of late cancellation or no-show, the prepaid deposit may not be refundable.

7. Limitation of Liability

Extreme sport risks: Paragliding is an extreme activity that involves potential risks to life and health.
xparagliding.com disclaimer: The Platform, its administration, founders, and employees assume no liability for physical harm, injury, fatal outcome, or property damage sustained by the user during the flight, takeoff, or landing.
Liability: All legal and financial responsibility for any potential incident rests entirely with the service provider company and/or the pilot who conducted the flight.

8. Ratings and Reviews

After completing a flight, users have the right to leave an objective rating and review about the pilot or company.
Posting obscene, offensive, discriminatory, or fraudulent content is prohibited.
The Platform administration reserves the right to remove comments that violate these rules without prior notice.

9. Intellectual Property

All materials on the Platform, including the xparagliding.com logo, website design, texts (excluding user-generated content), code, and graphics, constitute our intellectual property and are protected by copyright.

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Georgia. Any dispute related to the Platform that cannot be resolved through negotiation will be referred to the relevant courts of Georgia.

11. Changes to Terms

We reserve the right to make changes to this document at any time. Updated Terms take effect immediately upon publication on the website. The "Last Updated" date will be indicated at the top of the document.
